The labour and social affairs ministry is the competent authority for transposition of the Platform Work Directive. The ministry has held meetings with social partners on its proposals for the legislative text. The transposition will take the form of a new law.

From the trade union side, the VIDA union is co-operating with the Chamber of Labour (Arbeiterkammer) in the PWD transposition process. 

The ministry has developed a proposal for a general presumption of employment which is based broadly on facts indicating ‘direction and control’, without a specific criteria to trigger the presumption. This is a positive development

However, there are still question marks about other parts of the presumption, such as whether it will have to be triggered worker-by-worker rather than on a collective basis and whether a worker will have to go to court to trigger the presumption. The law is yet to go before the Austrian Parliament, so could still be subject to change.
